In 2018, the Agricultural Improvement Act, removed the definition of marijuana under the controlled substances act. This act classified hemp-derived products that contain less than 0.3% of THC as NOT a controlled substance. Furthermore, any product, including "Cannabidol" (CBD)products, that have a concentration of more that 0.3% THC remains classified as marijuana, which is a schedule I drug under the controlled substrances act.

How will CBD use impact you?

Whether you are a safety sensitive employee subject to drug testing, a non regulated employee who is subject to drug free workplace testing or an individual required to drug test, it is important that you are aware of the following information.

The Food and Drug Administration (FDA) does not currently certify the levels of THC in CBD products. Many of the CBD product labels can be misleading because the products could contain a higher level of THC than what the product labels states. Because there is no Federal oversight on these products to ensure the labels are accurate, individuals subject to drug testing should be cauitioned when using these products. The FDA has cautioned the public that: "Consumers should beware purchasing and using any [CBD] products." The FDA has stated: "It is currently illegal to market CBD by adding it to a food or labeling it as a dietary supplement."*

Can I use CBD in a DOT Safety Sensitive Position?

It is still unacceptable for any DOT safety sensitive employee subject to DOTs drug testing regulations to use marijuana. Furthermore, 49 CFR Part 40 does not authorize the use of any Schedule I drug including marijuana for any reason and the use of CBD is not a legitimate medical explanation for laboratory confirmed positive test results for marijuana. It is important to understand that using "marijuana free" CDB products may cause a positive result if the product contains 0.3% of THC in the product. Buyer beware when purchasing these products.
